Skilled Worker Route

The Skilled Worker route has replaced the Tier 2 (General) work route. This route allows eligible applicants to stay in the UK to do an eligible job with an approved sponsor/employer.

Eligibility Requirements

This is a points based applicaDon. You must score 70 points in total. These will be made up of mandatory and “tradeable” points, as follows:-

  • Mandatory 20 Points for sponsorship by a licenced sponsor

  • Mandatory 20 Points for job at an appropriate skill level

  • Mandatory 10 Points for English language skill at level CEFR B1 (intermediate)

    Tradeable points

    You must score 20 points for the salary. All jobs are classified using a “Standard OccupaDonal Code (SOC). The SOC determines the “going rate” or minimum salary required for the posiDon.

    You will score the required 20 points if they meet the criteria listed in OpDon A below.

    OpDon A
    The applicant’s salary equals or exceeds all of the following: £25,600 per year;
    £10.10 per hour; and
    The going rate for the occupaDon code.

    If the applicant’s salary is less than the above, they may be able to score the required 20 points by “trading points” for other “aaributes” or “characterisDcs” under OpDons B – F below.

    OpDon B
    PhD in a subject relevant to the job and the applicant’s salary equals or exceeds all of the following:
    £23,040 per year;
    £10.10 per hour; and
    90% of the going rate for the occupaDon code.
    In this opDon 10 points will be awarded for the educaDonal qualificaDon and 10 points will be awarded for the applicant’s salary.

    OpDon C

PhD in a STEM subject relevant to the job and the applicant’s salary equals or exceeds all of the following:
£20,480 per year;
At lea£10.10 per hour; and

At least 80% of the going rate for the occupaDon code.

OpDon D
Job in a shortage occupaDon and the applicant’s salary equals or exceeds all of the following: £20,480 per year;
£10.10 per hour; and
80% of the going rate for the occupaDon code

OpDon E
Applicant is a new entrant to the labour market and their salary equals or exceeds all of the following
£20,480 per year;
£10.10 per hour; and
70% of the going rate for the occupaDon code.

OpDon F
Job in a listed health or educaDon occupaDon and the applicant’s salary equals or exceeds both:
£20,480 per year; and
The going rate for the occupaDon code. An applicant with a job in a listed health or educaDon occupaDon can only be awarded tradeable points from opDon F.

Financial requirement (mandatory) for skilled worker visa

You must show you have sufficient funds to support themselves in the UK. This does not always require bank statements. Someone whose A-rated sponsor has “cerDfied maintenance” on their cerDficate of sponsorship, does not need to provide addiDonal evidence of finances. Similarly, someone who has lived in the UK for the conDnuous 12 month period prior to their leave to remain applicaDon date does not need to provide evidence of funds. People who do not meet the above criteria will need to provide bank statements covering the 28 day period prior to their applicaDon, showing funds of at least £1270 in their personal bank account.

Criminal record cerBficate requirement (mandatory) for a Skilled Worker

If you are applying for entry clearance for job in SOC codes (requiring criminal record cerDficate as per Appendix Skilled Worker) in that case criminal record cerDficate must also be provided.

How long you can stay

Your visa can last for up to 5 years before you need to extend it. You’ll need to apply to extend or update your visa when it expires or if you change jobs or employer. Applicant can

apply to extend their visa as many Dmes as they like as long as they sDll meet the eligibility requirements.

When can you apply for Indefinite leave to Remain

You becomes eligible for Indefinite leave to remain aker compleDon of probaDonary period of five years on specified routes, provided you meet all the requirements.

Switching to skilled worker visa

Switching to skilled worker visa is possible if you are already in the UK on a different visa. However, you cannot apply to switch to skilled worker visa if you are currently in the UK:

  • on a visit visa

  • on a short-term student visa

  • on a Parent of a Child Student visa

  • on a seasonal worker visa

  • on a domesDc worker in a private household visa

  • On immigraDon bail

  • because you were given permission to stay outside the immigraDon rules for example

    on compassionate grounds

    Family members eligible to join

    A Skilled Worker can bring their dependents which include the spouse, unmarried partner and children under 18.
